Terms of Service
Last Updated: September 21, 2026
Welcome to Tourney Maker. These Terms of Service govern your use of the Tourney Maker app and related services (collectively, the "Service") provided by Tim Baumgart ("we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
1. Scope and Applicability
These Terms apply to all users of the Tourney Maker app. There are no age restrictions for using our app.
2. Purchases and "PRO" Upgrades
The core features of Tourney Maker are free to use. We offer a paid "PRO" upgrade, which acts as a license that unlocks premium features for a specific tournament.
- All purchases are final, except as required by applicable law (such as the Right of Withdrawal for EU consumers detailed below).
- Prices shown for the "PRO" upgrade include applicable VAT.
3. User-Generated Content (Photos)
Users may upload photos within the Service. You retain all of your ownership rights in the photos you upload.
- You are solely responsible for the photos you upload. You may not upload content that is illegal, offensive, copyrighted (without permission), or otherwise inappropriate.
- Report Feature: We provide an in-app reporting feature. If a photo is reported, it is immediately hidden from view. We reserve the right to permanently delete reported content upon review.
4. Account Suspensions
We do not currently suspend or terminate user accounts. However, we reserve the right to remove any user-uploaded content that violates these Terms (as described in the User-Generated Content section).
5. Right of Withdrawal for Consumers
If you are a consumer under German law (§ 13 BGB), you generally have a statutory right of withdrawal when concluding a distance selling contract, which we instruct you about below.
Right of Withdrawal You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day of the conclusion of the contract.
To exercise the right of withdrawal, you must inform us (Tim Baumgart, Email: info@tourney-maker.com) of your decision to withdraw from this contract by an unequivocal statement (e.g., an email).
Loss of the Right of Withdrawal for Digital Content The right of withdrawal expires for a contract for the supply of digital content not supplied on a tangible medium (such as the immediate "PRO" upgrade) if we have begun performance of the contract after you have expressly agreed that we shall begin performance of the contract before the expiration of the withdrawal period, and you have acknowledged that by your agreement you lose your right of withdrawal once the performance of the contract has begun.
6. Limitation of Liability
We are liable without limitation for intent and gross negligence as well as in accordance with the German Product Liability Act (Produkthaftungsgesetz). For slight negligence, we are liable for damages resulting from injury to life, body, and health of persons. In the case of slight negligence, we are otherwise only liable in the event of a breach of a material contractual obligation (cardinal obligation), the fulfillment of which is essential for the proper execution of the contract and on the observance of which you may regularly rely. Liability in this case is limited to the foreseeable damage typical for the contract.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Federal Republic of Germany, without regard to the UN Convention on Contracts for the International Sale of Goods (CISG).
